Barker's Newsbites: Monday, July 7, 2014

Folks... you know you can do what I do - right?

Yes... my underlying education and knowledge base - and natural analytical abilities - allow me to make sense of the news... separate the wheat from the chaff... but the research itself... all it takes is time!

My home page is the Drudge Report. (The Drudge Report should be your homepage as well!)

You folks understand that Drudge is a consolidator... right? (You understand that The Drudge Report isn't a newspaper in and of itself, but rather, Drudge constantly browses world news reporting for interesting and informative stories which he links to... providing headlines... but otherwise standing aside.)

In other words... Drudge is a one-stop cyber news kiosk... one where by and large you can simply avail yourself of the reading while avoiding the paying!

(*HUGE FRIGGIN' GRIN*)

Anyway... between Drudge, the WSJ, NRO, Real Clear, and Zero Hedge... you'll be on your way to knowing what the heck is really going on! Throw in other favorites of mine - including the foreign press - and the chains of Sheeplehood should slowly but surely release you!

(*WINK*)

Pay attention, folks... don't let 'em manipulate you! We're now in the time of year known in media terms as "The Silly Season." Politicians and media figures take long vacations. The news is less "meat" and more "dessert" while under the "silly" stories the decline of America continues apace.

Keep reading Usually Right, folks; I'm trying... you should be too!

California Border Patrol union representative Ron Zermeno told ABC 10 San Diego that he has been placed under a gag order in an attempt to avoid negative news about the state of the southern border from getting out to the public.

* GEEZUS...

The order also comes after agents spoke out about the spread of infectious diseases near the border, which, according to ABC 10, they argued the public deserved to know about because it was a danger “like a threat to national security.

* NOTICE, FOLKS... YAHOO... THE AP...

MISSION, Texas (AP) — The influx of migrants crossing the U.S.-Mexico border has grown so large that it now requires its own transportation system: government buses that spend each night idling on a Texas roadside, awaiting the latest arrivals.

* FOLKS... THERE HAS BEEN A COUP. FOR ALL INTENTS AND PURPOSES OBAMA IS ACTING AS DICTATOR. CONGRESS HAS NOT LEGISLATED OUR BORDERS OUT OF EXISTANCE... NOR OUR IMMIGRATION LAWS. ALL THAT IS HAPPENING IS UNDER OBAMA'S "AUTHORITY" ALONE - AND OBVIOUSLY NO PRESIDENT HAS SUCH AUTHORITY.

An Associated Press reporter recently spent several days in this arid terrain, revealing a daily tide of migration that sends impoverished families into a harsh landscape bristling with cameras, lookout towers and heavily armed patrols. Against that backdrop, human smugglers and drug cartels match wits with overwhelmed American authorities.

* "OVERWHELMED" ONLY BECAUSE THIS IS WHAT OBAMA WANTS. FOLKS... WE HAVE A MILITARY! WE'RE NOT USING IT!

http://www.foxnews.com/opinion/2014/07/07/immigration-crisis-tuberculosis-spreading-at-camps/

Are the thousands of illegal immigrant kids housed in detention facilities happy and well fed - or are they living in disease-infested compounds shrouded in secrecy?

Well, it depends on who you ask.

The Department of Health and Human Services (HHS) seems to think the children coming across the southern border are remarkably healthy.

(*RAISING AN EYEBROW*)

It's a sentiment shared by BCFS -- the Texas-based agency formerly known as Baptist Child & Family Services contracted to run camps at Lackland Air Force Base in San Antonio and Fort Sill in Oklahoma.

* BUT OF COURSE THEY HAVE A FINANCIAL INTEREST IN SAYING SO.

(*SMILE*)

My source [Todd Starnes is host of Fox News & Commentary] said there are children showing classic tuberculosis symptoms -- spitting up blood, a constant cough and chest pain.

More than 7,000 children have been processed through the two camps, according to a BCFS official. They allege that only 119 children have been treated for lice, 22 for scabies, and one for the H1N1 Flu.

* ONLY 22 FOR LICE...??? REALLY...??? DOES THAT EVEN SOUND STATISTICALLY POSSIBLE...?!?!

At least a half dozen anonymous sources, including nurses and health care providers who worked at Lackland, allege that the government is covering up what they believe to be a very serious health threat. "The amount of tuberculosis is astonishing," one health care provider told me. "The nurses are telling us the kids are really sick. The tuberculosis is definitely there."

Texas Department of State Health Services Commissioner David Lakey, M.D. says state health officials have seen only three cases of tuberculosis, the Associated Press reports. One of my sources with close ties to the Texas HHS tells me all three cases were reported in Austin.

* BUT ARE STATE HEALTH OFFICIALS SCREENING ALL OF THESE ILLEGALS...?!?! (OR ARE THE FEDS USING ONLY THEIR OWN PEOPLE...???)

BCFS officials deny that any child at Lackland has been diagnosed with TB and the state health commissioner downplayed the health threat.

(*SHRUG*)

* ON THE OTHER HAND...

Dr. Marc Siegel, a professor of medicine at New York University's Langone Medical Center and a Fox News A Team medical contributor, said tuberculosis appears to be spreading through several counties in southern Texas. He told me that some counties are reporting twice the usual average number of cases.

"Some of the tuberculosis that comes from Central America is drug resistant," he told me. "It's not easier to spread but it is harder to treat. I'm concerned about that."

And while, TB is not that easy to spread, he warned that all those children living in close quarters could be a ticking time bomb. "It is a disease that needs to be carefully monitored and screened for - something that is not possible under the current circumstances," Siegel said.

* CONCLUDING... (Part 2 of 2)

HHS released a statement neither confirming nor denying what the nurses are telling me: "When unaccompanied children come into the Department of Health and Human Services program, they are given a well-child exam and given all needed childhood vaccinations to protect against communicable diseases,” the statement read. “They are also screened for tuberculosis, and receive a mental health exam. If children are determined to have any communicable disease or have been exposed to a communicable disease, they are placed in a program or facility that has the capacity to quarantine."

This is the same HHS that previously denied there were any cases of scabies.

They make it sound as if there are very few health problems among the illegals. They even downplay the lice epidemic - just 119 “officially confirmed” cases.

* YEAH... I'VE GOTTA SAY... WE REGULARLY EXPERIENCE LICE EPIDEMICS HERE IN THE AFFLUENT SUBURBS OF NEW YORK; IT DOES SEEM RATHER "STRANGE" THAT APPARENTLY "LICE ISN'T A PROBLEM" AMONGST ILLEGALS HOUSED IN CLOSE QUARTERS.

(*SHRUG*)

“They are lying,” one nurse told me. “We treated that many kids with lice on a given day. We would put 20 kids in front of us – 10 in each row. You could see the bugs crawling through their hair.”

Another former staff member told me it was like working in a giant emergency room. “They had children in the infirmary that had been there several days,” the former staffer told me. “You were on your feet non-stop. They had chicken pox, measles, and there was a concern strep was spreading.”

BCFS denied any of the children had the measles.

It's impossible to know the full extent of the communicable diseases that have come and are coming across the border. Nurses and other care givers tell me they've been told to keep their mouths shut. Those caught divulging information are subject to immediate dismissal - and all my sources said they were told they could also be arrested.

(*PURSED LIPS*)

BCFS won't even allow random inspections of their facilities by the media or members of Congress.

* YEP! THIS IS TRUE! IF YOU'VE BEEN READING USUALLY RIGHT YOU'VE READ THE STORIES HERE!

For 10 minutes, it seemed like the shooting was everywhere in the South Chicago neighborhood.

* CHICAGO... WHERE OBAMA WAS A "COMMUNITY ORGANIZER..."

It started when someone shot and wounded a couple, then two people fired at the shooter, then there was a chase and shots exchanged and a man sitting on a porch was hit. Responding officers kept cutting each other off on their radios as they reported other gunfire in the area late Sunday night and early Monday morning.

Then the heavy equipment rolled in: A helicopter and SUVs packed with lockers of rifles. SWAT teams in green coveralls patrolled the streets with uniformed officers.

* OBAMA'S CHICAGO. A THIRD-WORLD NATION SMACK IN THE CENTER OF AMERICA!

It was just one of dozens of shooting scenes across Chicago over the long Fourth of July weekend. In all, at least 82 people were shot, 14 of them fatally, since Thursday afternoon when two woman were shot as they sat outside a two-flat within a block of Garfield Park.

Many of the long weekend's shootings were on the South Side, clustered in the Englewood, Roseland, Gresham and West Pullman neighborhoods that rank among the most violent in the city.

* ANY... er... COMMON DEMOGRAPHIC REALITIES WE SHOULD KNOW ABOUT?

(*SMIRK*) (*SNORT*)

Each night of the long holiday weekend, at least a dozen people were shot in the greatest burst of gun violence Chicago has seen this year.

* STILL HALF THE YEAR TO GO!

* DID YOU KNOW PUERTO RICO IS ON THE EDGE OF BANKRUPTCY?

Here we go again: This time it's the commonwealth of Puerto Rico that has borrowed too much and is now signaling that it might not be able to pay it all back. The only question that remains is who will eat the losses.

Head doctors say that addicts have to reach rock bottom before they find the will to change their ways. It may be that Puerto Rico, high on cheap money from American creditors for the last decade, is reaching its nadir.

In late June Puerto Rican Gov. Alejandro García Padilla signed a bill into law allowing the "restructuring" of more than $19 billion of debt of the commonwealth-owned electricity, water and highway monopolies. The law stunned the municipal market because Puerto Rico has had a strong tradition of backstopping public-monopoly debt when necessary.

* IN ENGLISH...

Last week Moody's said that the law "provides a clear path to default for public corporations."

The new restructuring law may have been meant to reassure general-obligation bondholders that Puerto Rico is safeguarding the funds necessary to pay them first. Yet on June 30 Moody's reported that its one-year measure of Puerto Rico's "expected default" is higher than that of Argentina, Venezuela and Ukraine.

Investment companies Franklin Templeton and Oppenheimer Funds, which together hold $1.7 billion of electricity company Prepa debt, have challenged the new restructuring law in U.S. District Court in Puerto Rico. They argue that only the U.S. Congress can make bankruptcy rules. Puerto Rico says that there are no immediate plans to default, and on Tuesday Prepa remained current on its debt by making $418 million in payments to bondholders.

A Puerto Rican default should not surprise anyone. According to Carlos Colón de Armas, acting dean of the School of Business Administration at the University of Puerto Rico, for eight years from 2005 through 2012, government expenses exceeded revenues on average by approximately $1 billion annually.

The dean told me by telephone that total commonwealth debt is now around $73 billion and in 2013 it was 101% of the island's gross national product (GNP) up from 57% in June 2001.

Gov. García Padilla, who took office in 2013, increased expenses by almost $600 million in his first budget.

While he is now cutting spending, the cuts are mostly from that increase, according to Mr. Colón de Armas.

* TWO-PARTER... (Part 1 of 2)

http://jonathanturley.org/2014/07/07/so-sue-me-presidential-taunts-and-constitutional-consequences/

The pledge of the President to “go it alone” has already resulted in court losses for the Administration and a growing separation of powers crisis. I testified and wrote a column on President Obama’s increasing circumvention of Congress in negating or suspending U.S. laws.

I ran another column recently listing such incidents of executive over-reach that ideally would have included this potentially huge commitment under Obama’s claimed discretionary authority.

(I happen to believe that the President is right in many of these areas but that does not excuse the means that he is using to achieve these goals.)

The unanimous decision of the Supreme Court late last month that President Obama violated the separation of powers in appointing officials is the type of decision that usually concentrates the mind of a chief executive. Obama, however, appeared to double down on his strategy — stating in a Rose Garden speech on Tuesday that he intended to expand, not reduce, his use of unilateral actions to circumvent Congress. Summing up his position, the President threw down the gauntlet at Congress: “So sue me.”

The renewed promise to go it alone is a familiar refrain from this President. He even pledged to take unilateral action to circumvent Congress in front of both Houses, in his State of the Union address this year — to the curious delight of half of Congress, which applauded wildly at the notion of being made irrelevant.

* DEMOCRATS ARE SICK, FOLKS... SICK...

* FOLKS... HALF THE CONGRESS! WE'RE NOT TALKING A FEW "ROGUE" DEMOCRATS; WE'RE TALKING PARTISANSHIP UBER ALLES! WE'RE TALKING DEMOCRATS APPLAUDING "THEIR" PRESIDENT AS HE ATTEMPTS TO MAKE IRRELEVANT O*U*R CONSTITUTION... O*U*R RULE OF LAW... O*U*R AMERICA!

The President was as good as his word. When Congress failed to pass the Dream Act loosening immigration laws for certain groups, the President ordered the same result unilaterally.

* SAD THAT TURLEY CAN'T BRING HIMSELF TO WRITE "ILLEGALLY ORDERED." (I MEAN, CLEARLY, THAT'S WHAT HE BELIEVES!) (AND CORRECTLY SO!)

President Obama also ordered massive changes in ObamaCare — from lifting statutory deadlines, to exempting classes of business, to shifting hundreds of millions of dollars from appropriated purposes to other uses.

* AGAIN... ALL ILLEGAL ORDERS...

The political slogan of “no compromise” has migrated into legal strategy with disastrous results. That is precisely what happened in the recess appointments decision in NLRB vs. Canning. I testified on the President’s recess appointments in Congress after they were made and said that the nominations in my view were flagrantly unconstitutional. The fact that the administration decided to force a confrontation on such a weak case shows not just a lack of judgment but a cavalier attitude towards the costs of such losses.

(While he clearly has authority to set enforcement priorities in areas like immigration law, Obama has repeatedly stepped well over the line of separation.)

* TO BE CONTINUED...

William R. Barker said...

* CONTINUING... (Part 2 of 2)

These acts of defiance of Congress often come with chest-pounding acclaim, but they also come with costs. For example, by violating the Constitution on recess appointments, a huge array of rulings out of the National Labor Relations Board could be invalid — creating havoc in the area.

Likewise, the President’s recent loss in the Hobby Lobby case, regarding contraception provisions of ObamaCare, will require huge changes in such coverage.

In a case that may be issued any day now in Halbig vs. Burwell, the D.C. Circuit could strike down another unilateral policy on tax credits under ObamaCare that would mean that the administration wrongly committed billions of dollars without authority.

In our system, there is no license to go it alone. Rather, the Republic’s democratic architecture requires compromise. The process is designed to moderate legislation and create a broader consensus in support of these laws. Nor is congressional refusal to act on a particular prescription of how to fix the economy or repair immigration laws an excuse. Sometimes the country (and by extension Congress) is divided. When that happens, less gets done. The Framers understood such times. They lived in such a time.

While Obama did not create the über-presidency, he has pushed it to a new level of autonomy and authority.

* TRUE, OTHERS HAVE PUSHED EXECUTIVE POWER... GEORGE W. BUSH... BILL CLINTON... OUR HISTORY IS FULL OF GREATER AND LESSER EXAMPLES. OBAMA, THOUGH... (*SHAKING MY HEAD*)... HE'S LITERALLY PUSHED BEYOND CONSTITUTIONAL GOVERNMENT.

Obama's is a model that Democrats may soon regret. Just as this president has unilaterally rewritten federal laws and ordered the non-enforcement of others, the next President could use the same authority to gut environmental or employment discrimination laws.

(An über-President is only "liberating" when he is your über-President.)

And whether it is “sue me” or “bring it on,” presidential taunts tend to play better politically than practically. The invitation for a congressional lawsuit may sound on its face like it’s welcoming judicial review, but it’s not. Obama’s administration has fought to block such review by challenging the right of members and citizens to be heard in federal courts. Indeed, the House is preparing just such a lawsuit.
