The Obama administration is working to forge a sweeping international climate change agreement to compel nations to cut their planet-warming fossil fuel emissions, but without ratification from Congress.

* SO... IN ENGLISH... OBAMA IS ONCE AGAIN "WORKING" TO... BYPASS THE CONSTITUTION HE'S SWORN TO UPHOLD.

* WHY DO I HAVE TO TRANSLATE? WHY COULDN’T THE REPORTER OR EDITOR OR EVEN PUBLISHER OF THE NYT OPEN WITH THIS UNDENIABLE TRUTH?

In preparation for this agreement, to be signed at a United Nations summit meeting in 2015 in Paris, the negotiators are meeting with diplomats from other countries to broker a deal to commit some of the world’s largest economies to enact laws to reduce their carbon pollution. But under the Constitution, a president may enter into a legally binding treaty only if it is approved by a two-thirds majority of the Senate.

President Obama’s climate negotiators...

* AREN'T THEY "AMERICA'S" CLIMATE NEGOTIATORS?

...are devising what they call a “politically binding” deal that would “name and shame” countries into cutting their emissions. The deal is likely to face strong objections from Republicans on Capitol Hill and from poor countries around the world, but negotiators say it may be the only realistic path.

* YA GOTTA LUV IT! AS PREVIOUSLY NOTED - BY ME - THE DEMOCRATS CONTROL THE SENATE THAT OBAMA PLANS TO GO AROUND... BUT WHO DOES THE TIMES IDENTIFY AS THE OPPOSITION - THE REPUBLICANS!

“If you want a deal that includes all the major emitters, including the U.S., you cannot realistically pursue a legally binding treaty at this time,” said Paul Bledsoe, a top climate change official in the Clinton administration who works closely with the Obama White House on international climate change policy.

* SO WHY ARE YOU WASTING TAXPAYER DOLLARS?

Lawmakers in both parties on Capitol Hill say there is no chance that the currently gridlocked Senate will ratify a climate change treaty in the near future, especially in a political environment where many Republican lawmakers remain skeptical of the established science of human-caused global warming.

In seeking to go around Congress to push his international climate change agenda, Mr. Obama is echoing his domestic climate strategy. In June, he bypassed Congress and used his executive authority to order a far-reaching regulation forcing American coal-fired power plants to curb their carbon emissions. That regulation, which would not be final until next year, already faces legal challenges, including a lawsuit filed on behalf of a dozen states.

The Obama administration’s climate change negotiators are desperate to avoid repeating the failure of Kyoto, the United Nations’ first effort at a legally binding global climate change treaty. Nations around the world signed on to the deal, which would have required the world’s richest economies to cut their carbon emissions, but the Senate refused to ratify the treaty, ensuring that the world’s largest historic carbon polluter was not bound by the agreement.

* NOTICE THESE CRETINS AT THE TIMES DON'T BOTHER TO LIST THE MAJOR NATIONS WHICH DIDN'T SIGN KYOTO? NOTICE HOW THEY ATTACK THEIR OWN COUNTRY?

Seventeen years later, the Senate obstacle remains.

* WHAT THE TIMES IS CLEARLY UPSET AT IS THAT SEVENTEEN YEARS LATER... THE CONSTITUTION IS STILL (AT LEAST THEORETICALLY) THE LAW OF THE LAND. (SERIOUSLY, FOLKS... I DO BELIEVE THAT; I DO BELIEVE THAT THOSE ON THE LEFT HATE THE CONSTITUTION BECAUSE IT LIMITS THEIR POWERS EVEN WHEN THEY ARE ABLE TO OBTAIN OFFICE.)

Even though Democrats currently control the chamber...

...the Senate has been unable to reach agreement to ratify relatively noncontroversial United Nations treaties. In 2012, for example, Republican senators blocked ratification of a United Nations treaty on equal rights for the disabled, even though the treaty was modeled after an American law and had been negotiated by a Republican president, George W. Bush.

* LET ME GUESS... THEY'LL BE NO EXAMPLES OF SENATE DEMOCRATS BLOCKING RATIFICATION OF ANYTHING...

This fall, Senate Republicans are poised to pick up more seats, and possibly to retake control of the chamber.

Mr. McConnell, who has been one of the fiercest opponents of Mr. Obama’s climate change policy, comes from a coal-heavy state that could be an economic loser in any climate-change protocol that targets coal-fired power plants, the world’s largest source of carbon pollution.

Russian hackers attacked the U.S. financial system in mid-August, infiltrating and stealing data from JPMorgan Chase & Co. and at least one other bank, an incident the FBI is investigating as a possible retaliation for government-sponsored sanctions, according to two people familiar with the probe.

* RUSSIAN GOVERNMENT HACKERS... OR THE RUSSIAN MOB?

The attack resulted in the loss of gigabytes of sensitive data and authorities are investigating whether recent infiltrations of major European banks using a similar vulnerability are also linked to the attack, one of the people said.

In one case, the hackers used a zero-day vulnerability in one of the banks’ websites, then plowed through layers of elaborate security to steal the data, a feat several security experts said appeared far beyond the capability of ordinary criminal hackers.

The sophistication of the attack and technical indicators extracted from the banks’ computers provide some evidence of a government link, but the trail is muddy enough that investigators are considering the possibility that it’s cyber criminals from Russia or even elsewhere in Eastern Europe. Other federal agencies, including the National Security Agency, are now aiding the investigation, a third person familiar with the probe said.

“The way the Russians do it, to the extent we can see into the process, is they encourage certain targets,” said James Lewis, director of the Strategic Technologies program at the Center for Strategic and International Studies in Washington. “The Russians typically keep open the options to do something more, and the question now is what would trigger that and what would our response be.”

Attacks on the U.S. financial sector from Russia and Eastern Europe have jumped over that last several months, according to several cyber security experts, and both companies and U.S. officials are examining the possibility that the uptick is related to the conflict over Russia’s behavior in Ukraine.

Lois Lerner’s BlackBerry was intentionally destroyed after Congress had begun its probe into IRS targeting of conservative groups, a senior IRS lawyer acknowledged in a sworn declaration.

* IS THERE ANYTHING ELSE LEFT TO SAY, FOLKS?

News of the BlackBerry's destruction followed Monday’s statement by Judicial Watch that Justice Department attorneys said in a Friday phone call the federal government backs up all computer records to ensure continuity of government in event of a catastrophe, but retrieving the Lerner emails would simply be "too onerous."

Two top federal judges Wednesday said the nation’s immigration courts are in chaos, with the backlog of cases at an historic high of 375,000 for just 227 judges, leading to a minimum three-year delay in hearings for illegal immigrants.

* FOLKS... THIS IS DELIBERATE... DELIBERATE OBAMA/DEMOCRATIC PARTY POLICY.

In Washington to take advantage of the current crisis to demand a new court system, the judges accused the Justice Department of treating their courts like Cinderella’s abusive family by starving them of money and support and blamed the insufficient Justice funding for letting illegals “linger” in the country.

* ERIC HOLDER'S DEPARTMENT OF INJUSTICE...

“Immigration courts are the forgotten stepchild,” said Immigration Judge Dana Leigh Marks of San Francisco. She was speaking on behalf of the National Association of Immigration Judges, which she is president of.

Fellow Judge Denise Noonan Slavin, the vice president of the judge’s union, said that the courts have the “status of Cinderella,” having to scrounge for supplies, support and money. She said that the lack of money forces judges to delay cases and that is “allowing those who are not entitled to be here, linger.”

* ALL DELIBERATE...

During their appearance at a National Press Club event, they also said that the defense lawyers President Obama promised in June have not shown up. Obama pledged $2 million to Americorps, which was to supply the legal aid.

Asked if she had seen any yet, Marks said, “We have not.” Slavin, of Miami, said, “We haven’t seen an impact.”

While the judges said they are feeling pressure to speed up processing of the swarms of unaccompanied children crossing the border in the latest crisis, the caseload of about 1,500 per judge is bogging the system down. Marks said that it can take 15 months before the first hearing for an illegal is held, and then the final court session won’t take place for three to four years.

* JUSTICE DELAYED IS JUSTICE DENIED. (MY GUESS: OBAMA/HOLDER ARE TEEING UP THE SYSTEM SO THAT MOST ACTUAL DEPORTATIONS ORDERED WILL IN THE FUTURE SEE THE ORDERS REVERSED BASED UPON "UNFAIR INITIAL HEARINGS."

And the duo said the situation is getting worse — and may prompt judges to quit. “It’s a high-stress job,” said Marks. She said that there could be a “tsunami of retirements.”

The two judges recommended that the immigration court system be given an independent role, broken off from Justice, and properly funded. Marks said that the number of judges should be doubled.

“We don’t believe the Department of Justice is advocating for us,” said Marks. “We need to have more money.”

* THE DEPARTMENT OF INJUSTICE IS DELIBERATELY OVERLOADING THE SYSTEM. THEN... NEXT... "NEVER LET A CRISIS GO TO WORK."
